The PHOTOGRAPHER will carry out a nude photography session with the MODEL, in accordance with the conditions, locations, schedules and prices previously agreed between both parties. The session will take place at the agreed locations and duration, under an atmosphere of respect and professionalism, and with the aim of creating photographic works of an artistic nature.

The MODEL expressly authorizes the PHOTOGRAPHER to carry out editing and digital processing on the images obtained, in order to enhance their aesthetic value, without altering their dignity or distorting the artistic nature of the work.

The MODEL assigns to the PHOTOGRAPHER, with exclusive and indefinite character, all the rights of use of her image contained in the photographs resulting from the session, for artistic and promotional purposes of the author. This assignment includes the authorization for the reproduction, distribution, public communication and transformation of the images in any format or support, current or future, including digital media, social networks, exhibitions, contests, catalogs, books, websites, fairs, promotional material and other analogous channels.

The present authorization will maintain its validity as long as the works preserve their artistic or promotional purpose, and the MODEL may request in writing the revocation or limitation of certain uses, provided there are legitimate and reasonable grounds, and without prejudice to the rights acquired by the PHOTOGRAPHER up to that moment.

The MODEL may not disclose, reproduce or use the photographs taken without the express and prior authorization of the PHOTOGRAPHER, holder of the copyright on the work.

The original photographs, as well as the memory cards, digital files and other media, will remain in exclusive property of the PHOTOGRAPHER, who will keep the rights of exploitation and indefinite custody of the work.

In compliance with the Regulation (EU) 2016/679 (GDPR) and the Organic Law 3/2018, the MODEL is informed that the personal data and images collected through this session will be processed by the PHOTOGRAPHER, whose purpose is the creation, editing and dissemination of photographic works of an artistic nature. The MODEL may exercise her rights of access, rectification, deletion, opposition, restriction and portability by writing to the data controller at the address indicated at the beginning of the contract.

The PHOTOGRAPHER undertakes not to use the images for illegal, commercial or advertising purposes outside the artistic and promotional scope authorized. The MODEL declares that she gives her consent freely, specifically and informed, with full knowledge of the authorized uses.

This agreement shall be governed by Spanish legislation, in particular by the provisions of the Intellectual Property Law, the Organic Law 1/1982, the Organic Law 3/2018, and other complementary rules, the parties submitting to the Courts and Tribunals of the domicile of the PHOTOGRAPHER, unless there is a mandatory legal provision to the contrary.

1. In the event that the delivery of edited images to the MODEL has been agreed upon, this delivery shall be understood as part of the economic agreement between the parties, and shall be considered a partial compensation in kind or discount of the total price of the photographic service.
 These images are delivered solely for the personal use of the MODEL, not for commercial or advertising purposes, unless expressly authorized in writing by the PHOTOGRAPHER.

2. The MODEL is authorized to share the images privately, exclusively on their personal and private social networks, and always respecting the following conditions:

    * The photographs must retain the original signature or watermark of the PHOTOGRAPHER.

    * No modifications of any kind shall be permitted in format, size, cropping, color, filters, text, titles, or other visual elements.

    * In any publication, the PHOTOGRAPHER must be clearly mentioned or tagged as the author of the work.

3. In compliance with the Intellectual Property Law (Legislative Royal Decree 1/1996, of April 12), the PHOTOGRAPHER retains at all times the authorship and moral and patrimonial rights over the images.
 The MODEL agrees to respect the integrity and identity of the photographs, without alterations or modifications, and to maintain the author's reference in any publication or public use.

4. The omission of the PHOTOGRAPHER's name, alteration of the images, or their use outside the agreed terms shall constitute breach of contract and infringement of copyright, and the PHOTOGRAPHER may demand the immediate removal of the content and, if applicable, compensation for damages and losses.

5. In authorized publications or uses, the name of the PHOTOGRAPHER shall appear as follows:

    * On social networks: visible tag or direct mention.

    * In press or media: name next to the image or in credits.

    * On websites or catalogs: photo caption or credits section.

Michel Genève pays the models once the photo session is finished.

No advance payment will be made corresponding to the session rate. Only previously agreed extraordinary expenses, such as travel, sustenance, or other specific costs, which must be explicitly stated in the prior communication with the photographer, usually via WhatsApp, can be paid.

Payment to the model will only be made if the rights assignment agreement has been signed through the corresponding online form, which requires the model to upload a photograph of their identification document. This guarantees the authenticity of the signature and ensures that both parties accept the conditions of use and dissemination of the images.

This policy ensures clarity, transparency, and legal security, maintaining professionalism and respect in all collaborations.
